Two doctors - consultant obstetricians who worked at Caithness General Hospital had a terrible experience who through no fault of their own have ended up not only losing their jobs but having their careers and lives blighted by their treatment at the hands of the local health authorities in Highland.

Kazimierz Dabek  and Michal Samberger who have worked in several countries are from Poland where their families still reside.  Since the dismissal that has been rejected by the General Medical Council in the UK. They found that there was no evidence presented by NHS Highland.  Nor were there any complaints from any of the women treated by the two consultants.  The two doctors have retained legal advice and are currently making decisions with their legal advisers on possible actions.

However the publicity in newspapers and on the Internet continues to have a devastating effect on their employment.  It is with this in mind that this section is being put on the web with some information and articles published in the newspapers with the news that the GMC has found nothing to answer.  The dismissal had a great deal of publicity but the subsequent dismissal of the case has not had anything like the publicity to redress the balance.  Indeed search engines like Google still  may only find all the adverse publicity compounding the injustice done to the two consultants.

The matter has had a grave affect on the lives of Dr Dabek and Dr Samberger.  NHS Highland contacted all of the women treated by the two doctors asking for any complaints but received none.  In addition NHS highland informed other health authorities in the UK of their actions making it impossible for the men to obtain posts as obstetricians.

Had it not been handled in the way it was and coincided with a high profile campaign over the threat to downgrade maternity services at Caithness General Hospital things might not have been so bad.  North Action Group sought and obtained lots of publicity via the Caithness.org web site Maternity pages the North Action Group web site and newspapers, television and radio.

Polish Doctors Finally Get Their Case Into Court
It has been a long time coming but the case of the two Polish doctors finally reached the court.  See the BBC story below for details. 

Bill Fernie who met the doctors via his involvement acting for the North Action Group wrote a letter of support for the two doctors in 2004 and is appalled that their life has been put on hold for such a long time with all the worry and stress not say loss of livelihood caused by the whole situation.  The case was heard by the BMA and thrown out as their was no case to answer and NHS Highland did not present any evidence.  The case has reached the courts but even yet settlement is dragged out and another date set but at least the judge ruled that they do have a case and NHS Highland must come back to court.  So it continues while these two doctors sit scraping along for any odd bits of work they can get.
